OSHA COVID-19 Emergency Temporary Standard: What an OSH Professional Needs to Know

On Nov. 4, 2021, OSHA issued a new COVID-19 Vaccination and Testing Emergency Temporary Standard (ETS). The ETS requires large employers (100 or more employees) to develop, implement and enforce a mandatory COVID-19 vaccination policy, with an exception for employers that instead adopt a policy requiring employees to elect either to get vaccinated or to undergo regular COVID-19 testing and wear a face covering at work. Additional components of the ETS include paid leave to receive the vaccine and for recovery from side-effects. She holds an M.P.H. in Occupational Safety and Health from the University of North Carolina and is an ASSP Fellow. She is a frequent speaker at ASSP conferences, an instructor at SafetyFOCUS and a contributor to webinars.

Barry S. Spurlock, J.D., CSP
Barry_Spurlock_PERSONIFYBarry S. Spurlock is an associate professor at Eastern Kentucky University, a member-attorney with law firm Crump Spurlock and a founding partner of Safety Change Agents. His career has been devoted to the safety profession, working in manufacturing, insurance loss control, law and academia.

Courtney Malveaux, J.D., M.A., B.A.
Courtney MalveauxCourtney Malveaux is the principal at Jackson Lewis P.C., a law firm focused on labor and employment law. He represents employers in a variety of regulatory matters, particularly in citations by the OSHA and other agencies. As a former president of the National Association of Government Labor Officials, Malveaux has defended employers cited by OSHA and other agencies. He was also a commissioner with Virginia Department of Labor and Industry. He has testified before congressional and state legislative committees on workplace safety matters and crafted and advocated several bills to streamline regulatory agencies and help them partner with employers.

Julian D. Mercer, M.S., CSP, CRSP, ASP, CSHM, FIIRSM
Julian MercerJulian Mercer is director, global environmental, health and safety at Hexagon Composites, which delivers safe and innovative solutions for a cleaner energy future. As a member of the executive supportive team, he is the functional expert to the executive vice president of operations and CEO. For more than 25 years, he has successfully managed people and processes located in areas from rural North Carolina to the South Pole Station in Antarctica. He holds undergraduate degrees in industrial technology electronics and occupational safety and health from North Carolina Agricultural and Technical State University. He also holds an M.S. in Occupational Safety from East Carolina University.
