OSHA Proposes Rule to Better Protect Personally Identifiable Information

OSHA has issued a notice of proposed rulemaking that it says will better protect personally identifiable information or data that could be reidentified with a particular individual. This rulemaking would remove provisions of the agency's current recordkeeping rule.

Under the proposal, employers with 250 or more employees that must maintain injury and illness records would not be required to submit information electronically from OSHA forms 300 and 301. Instead, these establishments would only have to submit information electronically from OSHA Form 300A.

OSHA is not currently accepting data from forms 300 or 301 and will not enforce the deadlines for these two forms until further notice.
